After three hard fought years of litigation, Nicholas & Tomasevic secured a near-$16 million settlement on behalf of a certified class of Matco Tools Franchisees who were classified as independent contractors and not provided with the usual protections employees receive under California law like reimbursements for business expenses, overtime, and wage statements. Under the settlement, Matco Distributors will receive nearly $42,000 in value on average to resolve the claims that they should have been classified as employees.

California labor laws broadly protect workers who perform an integral service within the hiring company, like Matco Tool’s, business. The same is true if the hiring entity has the right to control the worker. For the full article on this settlement, click here.
